Sherwood | Two arrested in attempted break-in

Two men were arrested on May 25 on attempted burglary-related charges following Sherwood police being called to 209 Kellogg Acres in reference to unknown males attempting to break into that residence.

According to a police report compiled by the Sherwood Police Department, officers were dispatched there and arrested Russell Hitzroth, 40, of Sherwood; and Albert York, 40, of Naples, Fla.

Before positively identifying the suspects, Hitzroth was described as a large white man wearing a red tank top, shorts and a ball cap. York was described as a thinner white male wearing a white T-shirt and shorts.

“Dispatch further advised they left the area and were last seen walking toward Arkansas 107 on Kellogg Acres Road,” according to the police report.

Officers found Hitzroth getting into a red van in the parking lot of Mapco Gas Station and discovered York sitting on the passenger seat.

After the van left Mapco, police initiated a traffic stop at the corner of Amber Oaks Drive and Arkansas 107. Other officers went to 209 Kellogg Acres to find evidence of a break in.

Officer David Christman said he observed broken glass on the back door of the home and the dead bolt appeared to have been busted out.

Witness Linda Hamilton, 106 Amber Oaks, said she was in her back yard when she observed Hitzroth and York at the back of the Kellogg Acres home trying to push on the back door.

“Hamilton advised York looked at her and then tugged on Hitzroth’s shirt,” Christman said. “Hamilton further advised Hitzroth pushed York away and then broke the glass with the hammer. Hamilton then yelled to her husband to call the police and that is when Hitzroth saw her. Hamilton told me they took off in a hurry towards Highway 107 from the residence.”

Hamilton told police Hitzroth used a red claw hammer that had a black grip.

Inside the stopped van, police found a red claw hammer that had a black grip on it that he found between the front driver and passenger seats of the van.

Police ran a computer check on the van and found it registered in someone else’s name other than Hitzroth or York.

Hitzroth was arrested on charges of criminal attempt to commit residential burglary (C Felony), unauthorized use of another’s personal property to commit a crime (B Felony) and possession of an instrument of crime (misdemeanor).

York was arrested on charges of criminal attempt to commit residential burglary (C Felony), unauthorized use of another’s personal property to commit a crime (B Felony), possession of an instrument of crime (misdemeanor), carrying prohibited weapons and obstructing governmental operations.
